Terms of Service

1. Agreement to these terms

By using Eddy McPixel (the "Service"), you agree to these Terms of Service and our Privacy Policy. If you don't agree, please don't use the Service. The Service is operated by The Occult Arcade.

2. The Service

Eddy McPixel is a free, browser-based pixel art editor. Optional features include a free account, the community Palette Repo, and a paid "Premium" subscription that adds cloud backup and removes ads. The free editor remains fully usable without an account.

3. Your content & ownership

You retain all ownership and intellectual property rights in everything you create (artwork, canvases, layers, palettes, reference images and project files). We claim no ownership over your content and do not view, read, or use your private files; see our Privacy Policy.

License for published palettes

When you choose to publish a palette to the public Palette Repo, you grant Eddy McPixel a worldwide, non-exclusive, royalty-free license to host, store, display, and allow other users to import that palette, solely to operate the Repo. This license applies only to palettes you actively publish; not to any of your private work. You can delete your published palettes at any time.

4. Acceptable use

You agree not to use the Service to:

• upload, publish, or store prohibited or illegal content, including any material involving the sexual exploitation of minors (CSAM), non-consensual sexual content, or content that sexualises minors;
• infringe another person's intellectual property, privacy, or other rights;
• distribute malware, spam, or scams;
• attempt to disrupt, reverse-engineer, or overload the Service or its infrastructure; or
• use the Service for any unlawful or harmful purpose.

We may suspend access, remove content, or delete accounts that violate these rules, and we will cooperate with law enforcement where required.

5. Automated content scanning

As described in our Privacy Policy, images and canvases may be automatically scanned by automated systems for prohibited content. No human reviews your data as part of this process; human review occurs only where an automated system has flagged prohibited/illegal material, and only to the extent necessary.

6. Premium subscription & billing

• Premium is a recurring subscription billed monthly via Stripe at the then-current price (currently US$1.99/month).
• Your subscription renews automatically each month until you cancel. You can cancel at any time from the billing portal; you keep access until the end of the current paid period.
• Except where required by law, payments are generally non-refundable for the current period once charged.
• We may change Premium pricing; any change takes effect at your next renewal after reasonable notice.
• Premium features (cloud backup, ad removal, sync) depend on your account and may be affected by service interruptions or account suspension under these Terms.

7. No warranty

The Service is provided "as is" and "as available" without warranties of any kind. We don't guarantee the Service will be uninterrupted, error-free, or that your data will never be lost; please keep your own backups of work you care about.

8. Limitation of liability

To the maximum extent permitted by law, Eddy McPixel and The Occult Arcade are not liable for any indirect, incidental, or consequential damages, or any loss of data or profits, arising from your use of (or inability to use) the Service. Our total liability for any claim is limited to the amount you have paid us in the past 12 months.

9. Changes to the Service & these Terms

We may update or change the Service, and we may revise these Terms. We will post updated Terms here and update the "Last updated" date. Continued use after changes means you accept the revised Terms.

10. Termination

You can stop using the Service at any time. We may suspend or terminate access if you violate these Terms. Sections that by their nature should survive (ownership, licensing, liability, etc.) remain in effect after termination.
